1. Agreement to Terms

By hiring BasementCalculator (“we,” “our,” “us”), you (“client,” “you,” “your”) agree to these Terms of Service. These terms govern all services provided by us, including but not limited to basement finishing, design, construction, electrical, plumbing, and all related services. If you do not agree to these terms, you should not hire our services.

2. Services Provided

We offer professional basement finishing services that include:

  • Design and planning consultation
  • Framing, drywall installation, and other structural work
  • Electrical and plumbing services (if applicable)
  • Flooring installation (carpet, laminate, hardwood, etc.)
  • Insulation and waterproofing (if needed)
  • Custom cabinetry, built-ins, and finishing touches
  • Painting, lighting, and other finishing details

Additional services may be included depending on the scope of your project, as agreed upon before the commencement of work.

3. Project Estimates & Pricing

  • Estimates: All pricing estimates are provided after a thorough consultation and evaluation of the project scope. These estimates are non-binding and subject to change based on unforeseen circumstances or changes in the scope of work.
  • Fixed Pricing: Once the project scope is confirmed, we will provide a fixed price quote. Any changes or additions to the project may result in an updated price, which must be agreed upon before continuing work.
  • Payment Terms: A deposit of [X]% of the total estimated project cost is required to begin work. Payments will be due in installments as outlined in the contract, with the final payment due upon project completion.
  • Additional Costs: Any unexpected costs or changes requested by the client during the project (e.g., change in materials or scope of work) will be communicated and approved in writing before proceeding.

4. Project Timeline

  • Completion Time: We strive to complete projects on time. The estimated completion time will be provided in the contract, but unforeseen delays (e.g., material shortages, weather, or other factors beyond our control) may result in delays.
  • Client Responsibilities: Clients must ensure that the space is accessible and free from obstructions before work begins. Any delays caused by client actions or lack of preparation may result in a rescheduling of work and additional costs.
  • Delays: In the event of delays outside our control, we will notify you as soon as possible and provide a revised timeline.

5. Client Responsibilities

  • Access: The client must provide access to the property and basement area during regular working hours to facilitate the project.
  • Permits: The client is responsible for obtaining any necessary permits or approvals required by local municipalities unless otherwise stated in the contract. We will assist in the permit process if agreed upon beforehand.
  • Site Conditions: The client must disclose any known issues with the basement space (such as water damage, mold, structural issues) prior to the start of the project. Failure to disclose such issues may result in additional costs or delays.
  • Approval of Work: The client must approve any design or structural changes before work can proceed. Approval will be requested in writing, and any design changes made after work has commenced may incur additional charges.

6. Warranties and Guarantees

  • Workmanship Warranty: We offer a 5-year warranty on the workmanship of our basement finishing services. This warranty covers defects related to materials and workmanship but does not cover damage resulting from neglect, misuse, or external factors (e.g., water damage, foundation issues).
  • Manufacturer Warranties: Any materials used in the project, such as flooring, cabinetry, or appliances, may have separate manufacturer warranties. These warranties are subject to the terms of the manufacturer and are not provided directly by BasementCalculator.
  • Limitations: Our warranty does not cover issues arising from improper maintenance, natural disasters, or actions outside of our control.

7. Liability

  • Limitation of Liability: Our liability is limited to the total amount paid for services rendered. We are not liable for indirect, incidental, or consequential damages arising from the project, including loss of use, property damage, or personal injury.
  • Insurance: We maintain the appropriate insurance coverage to protect against property damage and personal injury related to our services. Proof of insurance is available upon request.

8. Termination and Cancellation

  • By Client: The client may cancel the project at any time before work begins with a written notice. If the project is canceled after work has started, the client agrees to pay for all work completed up to the point of cancellation, including any materials or services ordered.
  • By Us: We reserve the right to terminate the agreement if the client breaches any of the terms outlined in the contract, fails to make payments on time, or creates an unsafe work environment. In the event of termination, the client will be responsible for all services provided up to that point.

9. Dispute Resolution

Any disputes related to these Terms of Service or the services provided will be resolved through [mediation/arbitration] before seeking legal remedies. Both parties agree to work in good faith to resolve any issues that may arise.

10. Privacy and Confidentiality

We respect your privacy and are committed to protecting your personal information. Any personal or project-related information shared with us will be kept confidential and used only for the purpose of completing the basement finishing services. We will not sell or share your information with third parties without your consent, except where required by law.

11. Changes to Terms of Service

We reserve the right to modify these Terms of Service at any time. Any changes will be communicated to clients prior to the start of any new project. Continued use of our services after changes to the Terms of Service constitutes acceptance of those changes.
